Terms of Service

These Terms of Service (“Terms”) govern your use of Thought Bot AI (the “Application”), provided by Nicholson Handyman Service (“we,” “us,” or “our”). By accessing or using the Application—whether via web, mobile, or browser extension—you agree to be bound by these Terms. If you do not agree, do not use the Application.
1. Acceptance of Terms
By registering for, accessing, or using Thought Bot AI, you affirm that you are at least 18 years old (or the age of majority in your jurisdiction) and capable of entering into a legally binding agreement.
If you use Thought Bot AI on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms. “You” and “your” refer to the individual user or entity that accesses or uses Thought Bot AI.
2. Changes to These Terms
We reserve the right, at our sole discretion, to modify, update, or replace these Terms at any time. Material changes will be effective 30 days after posting an updated version to Thought Bot AI or notifying you directly (e.g., via email).
Your continued use of Thought Bot AI after any such changes constitutes acceptance of the revised Terms.
3. Description of Thought Bot AI
- Project management dashboard
- Automated quote and invoice generation
- Materials and pricing data lookup
- AI chat assistance (ThoughtBot)
- Integration with external services (e.g., web product searches, calendar, etc.)
AI-generated content. Many features of Thought Bot AI, including quote and estimate generation, materials suggestions, written documents, and chat responses, are powered by large language models and other AI systems. These outputs are generated automatically based on patterns in data and may be incomplete, incorrect, outdated, or not suitable for your specific job, location, or building codes. You understand and agree that all AI-generated content is for informational and drafting purposes only and must be reviewed and verified by you before use in your business or with your customers.
We may add, modify, or remove features from time to time without notice.
4. Account Registration & Credentials
Registration. To access certain features, you must register for an account and provide accurate, up-to-date information (e.g., name, email, business info).
Credentials. You are responsible for keeping your username, password, and any API tokens confidential. You agree not to share credentials with others or allow unauthorized use of your account.
Responsibility. You are solely responsible for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use or breach of security.
Account Termination. We reserve the right to suspend or terminate your account (with or without notice) if you violate these Terms or engage in prohibited conduct (see Section 5).
5. User Conduct & Prohibited Uses
- No interfering with, disrupting, or attempting unauthorized access to our servers or networks.
- No reverse-engineering, decompiling, or disassembling any portion of Thought Bot AI.
- No violation of applicable laws or third-party rights, including intellectual property.
- No uploading or distributing malicious code or unlawful content.
- No automated access via bots, scripts, or scrapers without permission.
- No harvesting personal data about other users without consent.
- No commercial use not explicitly permitted (e.g., reselling).
- No impersonation or misrepresentation of affiliation.
6. Subscription, Fees & Billing
Certain features may require a paid subscription. By subscribing, you authorize us to charge your payment method according to your chosen plan. Fees are non-refundable unless required by law, and subscriptions auto-renew unless canceled. You are responsible for taxes.
7. Intellectual Property & Licenses
Thought Bot AI and its content are owned by us or our licensors. You receive a revocable, non-exclusive license for internal business use. User Content remains yours, but you grant us a perpetual license to use it to operate and improve the Application. Feedback is also licensed to us perpetually.
8. Privacy & Data Usage
Our Privacy Policy at nicholsonhandymanservice.com/privacy explains data collection and usage. We collect usage analytics to improve the Application but do not sell personal data.
9. Disclaimers & Warranties
THOUGHT BOT AI IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
No guarantees on AI outputs. Thought Bot AI may generate quotes, cost estimates, materials lists, schedules, messages, and other content using artificial intelligence. THESE OUTPUTS MAY BE INACCURATE, INCOMPLETE, OR UNSUITABLE FOR YOUR SPECIFIC USE CASE. They do not take into account all real-world conditions, codes, regulations, or requirements at your job site. You are solely responsible for checking all numbers, quantities, prices, descriptions, and recommendations before using them in your business, contracts, or communications.
No professional advice. Thought Bot AI does not provide legal, financial, accounting, engineering, or other professional advice. Any information generated or displayed is for general information and drafting only and should not be relied upon as a substitute for consultation with qualified professionals. You remain responsible for your own pricing decisions, contract terms, safety practices, and compliance with all applicable laws, regulations, and building codes.
Third-party services. Third-party integrations (e.g., payment processors, calendars, external product links) are operated by their respective providers and are subject to their own terms and policies. We do not control and are not responsible for those services.
10. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunities, whether arising in contract, tort (including negligence), strict liability, or otherwise, even if we have been advised of the possibility of such damages.
Without limiting the foregoing, we are not liable for any losses or disputes arising from your use of AI-generated quotes, estimates, materials lists, schedules, or other content, including but not limited to underbidding or overbidding jobs, cost overruns, delays, project failures, customer complaints, contract disputes, property damage, or code violations. You understand that Thought Bot AI is a tool to assist you and that you remain solely responsible for verifying the accuracy and suitability of all outputs before relying on them.
In no event will our total aggregate liability arising out of or relating to the Application, these Terms, or your use of Thought Bot AI exceed the amount of subscription or other fees actually paid by you to us for access to the Application during the six (6) months immediately preceding the event giving rise to the claim.
11. Termination
You may terminate your account at any time; termination does not entitle you to refunds. We may suspend or terminate access for breaches of these Terms.
12. Governing Law & Dispute Resolution
These Terms are governed by Ohio law. Disputes should first be addressed informally via email. Unresolved disputes go to the state or federal courts in Tuscarawas County, Ohio. U.S. residents waive jury trials.
13. Indemnification
You agree to indemnify, defend, and hold harmless Nicholson Handyman Service, its owners, employees, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the Application or AI-generated content; (c) your business operations, projects, or services performed for your customers; or (d) any dispute between you and your customers or other third parties relating to quotes, estimates, invoices, contracts, schedules, or other materials that you created or modified using Thought Bot AI.
This includes, without limitation, claims that you undercharged or overcharged a job, failed to perform work as promised, violated building codes or safety regulations, or misrepresented information to a customer, regardless of whether you used AI-generated content as a starting point.
14. Third-Party Links & Services
We may link to third-party services; we do not endorse or control them and are not responsible for their content or policies.
15. Export Controls
You may not export or re-export the Application in violation of U.S. or foreign laws.
16. Severability & Waiver
If a provision is invalid, the remainder remains effective. Failure to enforce a right is not a waiver.

18. Definitions / Interpretation
“Application” means Thought Bot AI and all associated services.
“User Content” means any text, data, files, or other content you upload, post, or submit.
“Subscription” means a paid plan that grants access to certain features.
Other capitalized terms have the meanings given in these Terms.
19. Notices / Electronic Communications
We may send notices by email to the address you provide. You consent to receive all legal notices electronically.
20. Entire Agreement
These Terms (together with our Privacy Policy) constitute the entire agreement between you and us regarding Thought Bot AI, superseding all prior agreements or understandings.
21. Force Majeure
Neither party is liable for delays or failures caused by events beyond its reasonable control, including natural disasters, acts of war, strikes, government orders, or internet outages.
22. Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign or delegate our rights or obligations at any time without notice.
23. Confidentiality
We will treat your non-public data as confidential and use it only to operate and improve the Application. You agree not to disclose our non-public implementation details, pricing, or business plans.
24. Data Security
We implement commercially reasonable technical and organizational measures to protect your data. However, no security system is impenetrable. You acknowledge these risks and agree we are not liable for breaches or losses beyond our control.
25. Beta & Experimental Features
Any feature marked “beta” or “experimental” may be unstable. We provide such features “as is” and disclaim liability for errors or data loss.
26. AI-Generated Estimates, Quotes, and Content
Thought Bot AI is designed to help you work faster by generating draft quotes, estimates, materials lists, schedules, messages, and other content. However, it does not visit your job sites, measure actual conditions, inspect structures, or verify local legal requirements. AI-generated content is based on patterns and assumptions, not on a physical inspection.
You acknowledge and agree that:
- You are solely responsible for verifying the accuracy, completeness, and suitability of all AI-generated content before you present it to a customer, include it in a contract, or rely on it in your business.
- You are solely responsible for setting your own prices, markups, profit margins, timelines, and scope of work, and for ensuring that your work complies with all applicable laws, regulations, codes, and industry standards.
- We do not guarantee that any AI-generated quote, estimate, or recommendation is accurate, profitable, compliant, or appropriate for your specific project or jurisdiction.
- You will not represent to your customers that Thought Bot AI (or Nicholson Handyman Service) is responsible for your quotes, contracts, or work. Any agreement you enter into with a customer is solely between you and that customer.
